Terms of Service for Blink
Last Updated: September 4, 2026
Welcome to Blink. These Terms of Service ("Terms") govern your access to and use of the Blink live-streaming application and the website at theblink.live (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.
The Service is operated by Paska Innovative Enterprises LLC ("we", "us", "our"), based in Virginia, United States, under the Blink name. These Terms use the governing-law provision in Section 13.
Blink is currently offered only in the 50 U.S. states and the District of Columbia. U.S. territories and all other countries are outside the initial service territory. You may use the Service only while you are located in that territory.
1. Acceptance of Terms
By downloading, installing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
Blink is a live-streaming platform that lets users:
- Broadcast live video and audio from their device camera and microphone
- Watch other users' live streams
- Participate in live chat
- Send and receive tips and interact through follows, likes, and reactions
3. Eligibility and Accounts
- You must be at least 18 years old to create an account or use the Service. When you register you confirm that you are 18 or older; we record that confirmation with your account. We do not currently offer accounts to anyone under 18.
- Provide accurate registration information and keep it current.
- You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use.
- One account per person. Do not share account credentials.
4. User-Generated Content and Acceptable Use
Blink hosts live user-generated content. You are solely responsible for the content you broadcast, post, or transmit, and you represent that you have all rights necessary to do so.
Zero Tolerance for Objectionable Content
We have a zero-tolerance policy for objectionable content and abusive behavior. You may not broadcast, post, or transmit content that is:
- Sexually explicit, pornographic, or that sexualizes minors in any way
- Harassing, bullying, threatening, or that promotes hate based on protected characteristics
- Violent, gory, or that incites or glorifies violence or self-harm
- Illegal, or that facilitates illegal activity
- Infringing of intellectual property or privacy rights
- Spam, scams, or deliberately misleading content
- Pre-recorded, synthetic, or AI-generated or AI-altered video presented as live — Blink is live-only, and we apply no filters or effects of our own. Your feed may come from any internet-connected device (camera, phone, drone, sensor rig, or receiver), but it must be live as broadcast: no file playout, no delayed replay, no synthetic or AI-generated video. Platform-operated Blink Relay channels rebroadcast labeled third-party live cameras (public-domain sources, or operators who granted written permission) under this same live rule; sources that are periodically refreshed stills rather than continuous video are labeled as such
Community Safety Tools
The app provides tools to keep the community safe:
- Report: submit a report about any stream or user; reports are automatically routed and prioritized.
- Block: block a user so you no longer see their content or interactions.
You must accept our content acknowledgement (EULA) before broadcasting or viewing live content.
Moderation and Enforcement
We may review reports and content, and we may remove content, restrict features, suspend, or permanently ban accounts that violate these Terms. We may use automated systems to route and prioritize reports. Authorized reviewers decide what action to take. Deadlines required by applicable law continue to apply.
5. Content Ownership and License
- Your content: you retain ownership of content you create. You grant Blink a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and distribute your content solely to operate and provide the Service (for example, to deliver your live stream to viewers).
- Our content: the Service, including its software, design, and trademarks, is owned by Blink and its licensors. You may not copy, modify, reverse engineer, or create derivative works except as permitted by law.
6. Payments, Tips, and Purchases
- Tips and other digital purchases made in the mobile app are processed through the applicable app store (Apple App Store or Google Play) using in-app purchases, subject to the app store's terms.
- Where payments are processed on the web or for payouts, our payment processor is Stripe.
- Except where required by law or by the app store's policies, purchases are non-refundable.
- Creators who receive tips may be subject to additional payout terms and identity/tax verification through our payment processor.
7. Privacy
Your use of the Service is subject to our Privacy Policy, which explains how we collect and use your information, including camera and microphone access used for broadcasting.
8. Copyright and DMCA
We respect intellectual property rights. If you believe content infringes your copyright, send a DMCA notice to [email protected] with the information required by the U.S. Digital Millennium Copyright Act. We respond to valid notices, may remove infringing content, and terminate repeat infringers.
9. Termination
- By you: you may delete your account at any time from the in-app Settings/Profile screen or by contacting [email protected].
- By us: we may suspend or terminate your access for any violation of these Terms or for conduct that we reasonably believe harms users or the Service.
- Some provisions survive termination, including ownership, disclaimers, limitation of liability, and dispute resolution.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that user content will be accurate or appropriate.
11. Limitation of Liability
To the maximum extent permitted by law, Blink will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or USD 100.
12. Indemnification
You agree to indemnify and hold Blink harmless from claims, damages, and expenses arising from your content, your use of the Service, or your violation of these Terms or the rights of others.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-laws rules. You agree that disputes will be resolved in the courts located in Virginia, USA, except where applicable law provides otherwise.
14. Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a new "Last Updated" date and, for material changes, provide notice in the app or by email. Continued use after changes take effect constitutes acceptance.
15. Severability
If any provision of these Terms is held invalid, the remaining provisions remain in full force and effect.
